The statutory system is the general community property regime, whereby, each of the spouses is entitled to half. The spouses may deviate from this and agree different arrangements.
It is usual that parties draft a divorce agreement before filing the divorce petition, in which they arrange matters.

When parties come to a settlement, the mediator will record the couple’s decisions in a written agreement.
Legally end your marriage or registered partnership
You will need to go through the formal divorce or dissolution process. Our lawyer can take care of the joint petition for divorce or dissolution partnership. The court will be asked to include the agreement in its ruling. The divorce or dissolution partnership takes effect upon the recording of the court ruling in the registers of births, deaths and marriages.
If there are no children, termination of the registered partnership can be done without going to court. The partners draw up and conduct an agreement. Our lawyer declares that such an agreement had been conducted, after which this agreement is recorded in the registers of births, deaths, marriages and registered partnerships. If there are children, the same procedure applies as in the case of a divorce.
